About these terms
These terms are an agreement between you and ("we", "us"), which runs nine16. By creating an account or buying credits you agree to them. If you're using nine16 for a business, you confirm you can accept them on its behalf.
If you're a consumer, nothing here affects your legal rights under UK consumer law.
Your account
Credits
- 1 credit makes 1 finished clip. Re-cutting a clip you already have is free.
- When a project starts we hold the credits it could use. Credits for clips we don't deliver, including clips that fail to render, go back to your balance automatically.
- Plan credits are added at the start of each billing month and are used first. Unused plan credits don't carry over to the next month, and stop when a plan ends.
- Welcome credits and top-up credits don't expire while your account is open.
- If a payment is refunded, we remove the unused credits it bought (see Refunds).
- Credits have no cash value and can't be transferred, sold or exchanged.
Buying plans and credits
- Payments are handled by Stripe. Plans and credits are sold through Link, a Stripe service, which acts as the merchant of record: it takes your payment, works out and collects any VAT or sales tax, and sends your receipt and invoice. Your bank statement will show "LINK.COM*" followed by our name. Link's payment terms, shown at checkout, cover the payment itself; these terms cover nine16, the service you're paying for.
- Prices are shown on our pricing page in pounds sterling and include VAT where it applies. At checkout Stripe may show the price in your local currency; if it does, it shows the exchange rate before you pay.
- Your plan or credits are added as soon as Stripe confirms the payment, usually within a few seconds.
- We may change prices for future billing periods. We'll tell you at least 30 days before a change affects you, and you can cancel before it does.
Changing or cancelling a plan
- Plans renew automatically every month on the date you first subscribed, until you cancel.
- You can cancel at any time with "Cancel plan" on the Billing page, from "Invoices and card details" there, or at link.com. Your plan stays active until the end of the month you've paid for. Then your account moves to Free: unused plan credits end, and your welcome and top-up credits stay. Until then you can change your mind with "Keep my plan".
- Upgrading takes effect straight away. You pay the difference in price for the rest of the current month, and get the larger plan's extra credits for the rest of the month in the same proportion.
- Downgrading takes effect when your plan next renews. You keep your current plan and its credits until then.
- If a renewal payment fails, Stripe tries again over the following days and emails you so you can update your card. If it still can't take the payment, your plan ends and your account moves to Free.
Refunds and your right to cancel
Your right to cancel
As a UK consumer you normally have 14 days to cancel a purchase of digital content. Because credits can be used straight away, when you buy we ask you to agree that we start supplying them immediately. Once you've used any credits from a purchase, your right to cancel that purchase ends. If you haven't used any, you can cancel within 14 days for a full refund by emailing or contacting Link support from your receipt.
Other refunds
Otherwise payments aren't refundable, except where the law says they must be or where we've failed to provide the service. As the merchant of record, Stripe can also refund a payment, for example after a request to Link support. Refunds go back to the card or account you paid with.
What happens to your credits
- When a payment is refunded, we remove the credits it bought: all of them for a full refund, or a matching share for a partial one. Credits you've already used aren't charged back, and we never take more than you have left of the same kind (plan credits, or welcome and top-up credits).
- Plan credits are only removed if the refund is for the current month's payment. Credits from earlier months have already ended.
- A refund doesn't cancel your plan. To stop future payments, cancel it as described above.
Your videos and clips
- You keep all rights to the videos you bring and the clips we make from them.
- You give us permission to store, process and copy your videos only as needed to run nine16 for you, including sending transcripts to our AI provider to choose clips.
- You must own your videos or have permission to use them, including permission to download them and post clips from them. You're responsible for following the terms of YouTube and any platform you post to.
- We may remove content and suspend accounts when we're told, or have good reason to believe, that content infringes someone's rights.
Acceptable use
Don't use nine16 to:
- process content that's illegal, infringes someone's rights, or promotes violence, abuse or hatred;
- harass or impersonate anyone, or mislead people about who made a clip;
- get around credits, limits or security, or overload the service with automated requests;
- resell or give access to nine16 without our written agreement.
AI features
Clip choices, virality scores, titles, descriptions, hashtags and captions are generated automatically and can be wrong. Scores are an estimate, not a promise of views. Check every clip before you post it.
The service
We work to keep nine16 running and your files safe, but we can't promise it will always be available or error-free. We may change or improve features. If we ever close the service, we'll give you at least 30 days' notice to download your clips and will refund unused top-up credits.
nine16 isn't affiliated with or endorsed by YouTube, TikTok, Instagram or Facebook.
Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.
Otherwise, we aren't responsible for losses that weren't foreseeable, for business losses such as lost profit or opportunity, or for what happens to clips after you post them. Our total liability to you is limited to the amount you paid for nine16 in the 12 months before the claim.
Ending your account
You can close your account at any time by emailing us. If you have a plan, we cancel it when we close your account, so you won't be charged again. Unused credits end when the account closes and aren't refunded, unless you're still within your right to cancel.
We may suspend or close accounts that break these terms; where it's reasonable we'll warn you first and give you the chance to download your clips.
Law and changes
These terms are governed by the law of , and its courts deal with any disputes. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
If we change these terms in a way that matters, we'll tell you before the change takes effect. Questions: .
